Terms & Conditions

Welcome to Deliver-It. The following Terms & Conditions apply to all of DI Overnite’s Same-Day and Next-Day products and services, unless otherwise specified in individual service agreements with DI Overnite. By signing up and utilizing DI Overnite services, you agree that you have read, understand and agree to these Terms & Conditions. We reserve the right to change or modify these Terms & Conditions from time to time and at its sole discretion. Your use of DI Overnite services constitutes your acceptance of such changes.

Limitation of Liability

DI Overnite limits its maximum liability to $100 (U.S.) for any loss, damage, the actual value of package contents or the cost to recreate the contents of any package shipped, whichever is less. DI Overnite customers do have the option of insuring their shipment up to $10,000; some restrictions apply. We will not accept liability for service for which the shipper has authorized DI Overnite (either verbally or in writing) to deliver the shipment without obtaining a signature.

DI Overnite will not accept liability for any damages whether direct, incidental, special or consequential, including but not limited to loss of income or profits, whether or not we had knowledge that such damages might be incurred.

DI Overnite will not be liable for your acts or omissions, including but not limited to improper or insufficient packaging, securing, marking, or addressing of your shipment, or for the acts or omissions of the recipient. We will not accept liability for items which are not fully enclosed in a carton or proper packing material.

We will not be liable for loss, damage or delay caused by events we cannot control, including but not limited to acts of God; air, land or sea transportation delays; weather conditions, acts of public enemies or terrorists; war; strikes, civil commotion or acts or omissions of public authorities, including customs or health officials with actual or apparent authority.

DI Overnite may at its option (but without obligation on the part of DI Overnite to do so) open and inspect Company’s packages prior to or after given to DI Overnite to deliver. DI Overnite reserves the right to reject a shipment at any time, when such shipment would be likely to cause damage to or delay to other shipments, equipment or personnel, or if the transportation of such shipment is prohibited by law.

Account & Password

DI Overnite customers are solely responsible for maintaining the confidentiality of account information and passwords and are liable for all activities and costs affiliated with those activities. DI Overnite reserves the right to refuse service, terminate accounts, remove or edit content or cancel service at its sole discretion.

Address Correction

When an address correction is required after our drivers are in transit, a $6.00 $10.00 charge will be applied. If an address correction is made in advance of the drivers being in transit and the same morning route driver can make the delivery, no additional shipping fee will be addressed.

Auto-Pay

The Auto Pay program is available to all DI Overnite customers who prefer the convenience of maintaining a credit card on file with us and having their account paid automatically bi-monthly each month. Billing & Invoices

DI Overnite customers are invoiced twice a month. The invoice dated the 15th includes shipments picked up and delivered between the first day of the month and the 15th. The second invoice includes shipments picked up and delivered between the 16th and the last day of the month. Payment terms are Net 15. If payment is not received within 30 days of invoice issue date, a late charge of 1.5% will be applied. Accounts more than 45 days past due will be placed on credit hold.

DI Overnite customers have the option of receiving a paper or an electronic invoice; customers who request a paper invoices will incur a $3 per invoice fee.

COD Policy

Deliver-It’s C.O.D. Service will collect funds on your behalf at the time of delivery. Checks, including cashier’s, certified, business and personal checks and money orders for the C.O.D. amount will be collected at the shipper’s sole risk, including, but not limited to risk of non-payment, insufficient funds, fraud or forgery. Failure to specify a payment type will result in DI Overnite accepting the funds presented as payment. DI Overnite cannot accept cash, travelers checks, credit cards or counter checks as payment for a C.O.D. shipment.

C.O.D. amounts do not imply a declared value. If you wish to place a valuation higher than $100 on your package, you must declare a value for the shipment when placing your order. There is a service charge of $7.50 for C.O.D. shipments.

Driver wait time for collection of C.O.D. funds from recipient is five minutes, with a waiting time charge of $.50 per minute beyond five minutes.

Delivery Areas Restrictions

DI Overnite’s service area includes all of Southern California, Arizona and Nevada, however some zip code areas we service that are in less populated or less accessible areas will incur a Delivery Area Surcharge. Please contact a Customer Service Representative for additional information.

Delivery Signature

It is DI Overnite’s policy to obtain a signature on all deliveries. However, shipments may be delivered without obtaining a signature if the sender indicated as such when placing the order online or has given verbal or written authorization to an DI Overnite Customer Service Representative. However, if authorization is given to DI Overnite to leave without signature, DI Overnite assumes no liability for the loss of the package.

Fuel Surcharge

DI Overnite’s industry standard fuel surcharge analyzed and adjusted bi-monthly and reflects the average cost of fuel in the Metropolitan Statistical Area (MSA) of Southern California.

Government Buildings

Due to the variety of parking and security restrictions at various pick-ups at various government buildings DI Overnite’s Same-Day order types must be used when placing orders for these locations. DI Overnite will not pick-up and/or deliver to government buildings on routed services.

Hazardous Materials

Biohazardous items such as blood, urine, fluids or other infectious diagnostic specimens must be safely packaged to meet DI Overnite specifications for transport. It is the responsibility of the shipper to ensure that a shipment tendered to DI Overnite does not violate any federal, state, local laws or regulations. DI Overnite will, at our sole discretion, ship Other Regulated Materials (ORM-D). ORM-D is typically a consumer commodity which would ordinarily be regulated as a hazardous material but which presents limited hazard due to its smaller quantity, form and packaging for which a limited quantity exception is provided for in the DOT regulations. DI Overnite transports ORM-D shipments via ground only, we do not ship ORM-D by air.

Packaging & Supplies

Though not required, DI Overnite shipping supplies such as polytech mailers, label sleeves and labels – if using an DI Overnite printer – are available to all customers upon request. DI Overnite’s shipping supplies are available at no cost to eligible customers who ship 100-plus shipments per month and maintain accounts in good standing. DI Overnite customers who place fewer than 100 orders per month may purchase supplies. Costs can be obtained by contacting Customer Service or emailing salessupport@deliver-it.com.

While DI Overnite does not require our customers to use DI Overnite shipping supplies, all envelopes and boxes must be completely sealed and packaged sufficiently. DI Overnite will not be liable for your acts or omissions, including but not limited to improper or insufficient packaging, securing, marking, or addressing of your shipment, or for the acts or omissions of the recipient. We will not accept liability for items which are not fully enclosed in a carton or proper packing material.

DI Overnite reserves the right to reject a shipment at any time, when such shipment would be likely to cause damage to or delay to other shipments, equipment or personnel.

DI Overnite recommends the following package guidelines and procedures for prompt delivery of your shipment:

  • Use proper packaging relative to the contents of the shipment
  • Remove any labels and/or markings from previous shipments
  • Never use competitor packaging (i.e. USPS, FedEx. UPS*, etc.) as these shipments can and will be refused
  • Use an DI Overnite shipping label on all shipments

Packages not properly labelled with an DI Overnite barcode will be refused. In the event that DI Overnite does pick-up a package that is not properly labelled, the shipment will be subject to a $10.00 service fee.

*From this USPS website: Priority Mail Express, Priority Mail, or Global Express Guaranteed packaging provided by the US Postal Service can only be used for the class of mail specified on the box (Priority Mail Express® service, Priority Mail® service, or Global Express Guaranteed®). Misuse may be a violation of federal law.

Prohibited Items

DI Overnite reserves the right to decline the shipment of certain items. Prohibited items for shipment with DI Overnite include but are not limited to: Illegal goods or substances, cash or cash equivalents, coins, firearms or ammunition, jewelry, medical marijuana, precious metals, antiques or artwork, collectible stamps, animals alive or dead, alcoholic beverages, toxic waste or fuel of any kind. DI Overnite reserves the right, but is not required, to open and inspect any package at any time if we determine that such shipment would be likely to cause damage or delay to other shipments, equipment or personnel of the Company or if the transportation is prohibited by law. It is the responsibility of the shipper to ensure that a shipment tendered to DI Overnite does not violate any federal, state, provincial, or local laws or regulations. No service shall be rendered by DI Overnite in the transportation of any shipment that is prohibited by law.

Residential Delivery Service

Pick-ups and /or deliveries to residences, including those in remote or less-accessible areas, will be assessed an additional service fee.

Size & Weight Restrictions

DI Overnite reserves the right to weigh all shipments and our policy is to round to the nearest pound. DI Overnite utilizes industry standard practices with regard to special handling fees based on “Dimensional Weight” when a package it relatively light compared to its actual volume. All packages which due to length require special handling will also be subject to special handling fees. Packages sent weighing more than DI Overnite’s published weight limitations will be subject to an additional charge.

Shipping Label Policy

Packages not properly labelled with an DI barcode could be refused. In the event that DI Overnite does pick-up a package that is not properly labelled, the shipment will be subject to a $10.00 service fee.

Undeliverable

The prompt and secure delivery of our clients’ shipments is of the utmost importance.

Orders that do not include instructions to release the package without signature will be returned to our local facility and we will attempt to contact you by phone or email for further instructions. If we are unable to reach you after 24 hours, the package will be returned to the sender unless other arrangements are made.

Waiting Time Charges

All shipments should be securely packaged and addressed in advance of pick-up time. After a five-minute courtesy window, a waiting time fee of $.50 per minute will be charged.
