Welcome to All Counties Courier (ACC). The following Terms & Conditions apply to all of the Company’s Same-Day and Next-Day products and services, unless otherwise specified in individual service agreements with ACC. By signing up and utilizing ACC services, you agree that you have read, understand and agree to these Terms & Conditions. ACC reserves the right to change or modify these Terms & Conditions from time to time and at its sole discretion. Your use of ACC services constitutes your acceptance of such changes.

Limitation of Liability
ACC limits its maximum liability to $100 (U.S.) for any loss, damage, the actual value of package contents or the cost to recreate the contents of any package shipped, whichever is less. ACC customers do have the option of insuring their shipment up to $5000 with UPIC (www.UPIC.com); some restrictions apply. We will not accept liability for service for which the shipper has authorized ACC (either verbally or in writing) to deliver the shipment without obtaining a signature.
ACC will not accept liability for any damages whether direct, incidental, special or consequential, including but not limited to loss of income or profits, whether or not we had knowledge that such damages might be incurred. ACC will not be liable for your acts or omissions, including but not limited to improper or insufficient packaging, securing, marking, or addressing of your shipment, or for the acts or omissions of the recipient. We will not accept liability for items which are not fully enclosed in a carton or proper packing material.
We will not be liable for loss, damage or delay caused by events we cannot control, including but not limited to acts of God; air, land or sea transportation delays; weather conditions, acts of public enemies or terrorists; war; strikes, civil commotion or acts or omissions of public authorities, including customs or health officials with actual or apparent authority.
ACC reserves the right to decline the shipment of certain items. Items not acceptable, and for which ACC will not be liable for, include but are not limited to: shipments of illegal goods, cash, or cash equivalents, negotiable instruments, stamps, coins, jewelry, precious metals, original artwork, antiques, one-of-a-kind items or live animals.
ACC may at its option (but without obligation on the part of ACC to do so) open and inspect Company’s packages prior to or after given to ACC to deliver. ACC reserves the right to reject a shipment at any time, when such shipment would be likely to cause damage to or delay to other shipments, equipment or personnel, or if the transportation of such shipment is prohibited by law.

Account & Password
ACC customers are solely responsible for maintaining the confidentiality of account information and passwords and are liable for all activities and costs affiliated with those activities. ACC reserves the right to refuse service, terminate accounts, remove or edit content or cancel service at its sole discretion.

Address Correction
When an address correction is required after a delivery attempt is made, a $6.00 charge will be applied. If an address correction is made in advance of the delivery attempt and the same morning route driver can make the delivery, no additional shipping fee will be assessed.

Billing & Invoices
ACC issues invoices to its customers twice a month. The invoice dated the 15th includes shipments delivered between the first day of the month and the 15th. The second invoice includes shipments delivered between the 16th and the last day of the month. ACC customers have the option of receiving a paper or an electronic invoice. ACC terms are Net 15. Any accounts with invoices outstanding more than 30 days may have service suspended. Accounts that are on credit hold by ACC’s Accounting department are not eligible to receive a refund

Claims & Refunds
All claims regarding damages to, loss or delay of any shipment must be submitted in writing to ACC’s corporate office within 15 calendar days of delivery of the shipment; otherwise ACC reserves the right to refuse the claim. ACC is not obligated to act on any claim until you have paid all transportation charges, and you may not deduct the amount of your claim from those charges.

COD Policy
All Counties Courier’s C.O.D. Service will collect funds on your behalf at the time of delivery.
Checks, including cashier’s, certified, business and personal checks and money orders for the C.O.D. amount will be collected at the shipper’s sole risk, including, but not limited to risk of non-payment, insufficient funds, fraud or forgery. FAILURE TO SPECIFY A PAYMENT TYPE WILL RESULT IN ACC ACCEPTING THE FUNDS PRESENTED AS PAYMENT.
Cash, traveler’s checks, credit cards and counter checks will not be accepted as payment for a C.O.D. shipment.
The maximum acceptable C.O.D. amount is $10,000 per shipment. C.O.D. amounts do not imply a declared value. If you wish to place a valuation higher than $100 on your package, you must declare a value for the shipment when placing your order. There is a service charge of $8.50 for C.O.D. shipments.
Driver wait time for collection of C.O.D. funds from recipient is five minutes. If the recipient cannot be located or fails or refuses for any reason to pay the C.O.D. amount, the shipment will be returned to the Shipper within two business days of the final delivery attempt. C.O.D. Service is only available to ACC Account holders

Delivery Areas & Restrictions
ACC service area includes all of Southern California and most Central and Northern California metro locations. Some of the zip code area we service are in less populated or less accessible areas and may incur a Delivery Area Surcharge. Please contact an ACC Customer Service Representative if you think your delivery may be in this type of location. ACC does not deliver to P.O. Boxes.

Delivery Signature
It is ACC’s policy to obtain a signature on all deliveries. However, shipments may be delivered without obtaining a signature if the sender indicated as such when placing the order online or has given verbal or written authorization to an ACC Customer Service Representative. If authorization is given to ACC to leave without signature, ACC assumes no responsibility for the loss of the package.

Fuel Surcharge
ACC’s industry standard fuel surcharge is analysed and adjusted bi-monthly and reflects current market conditions is based on the AAA of Southern California average price of gasoline as posted on http://www.fuelgaugereport.com/CAmetro.asp

Hazardous Materials
ACC will not accept for carriage packages containing hazardous materials, hazardous substances or inhalation hazards, bio-hazards such as blood, urine, fluids or other infectious diagnostic specimens or packages leaking fluid, if not safely packaged for transport. It is the responsibility of the shipper to ensure that a shipment tendered to ACC does not violate any federal, state, local laws or regulations.
ACC will, at its sole discretion, ship Other Regulated Materials (ORM-D). ORM-D is typically a consumer commodity which would ordinarily be regulated as a hazardous material but which presents limited hazard due to its smaller quantity, form and packaging for which a limited quantity exception is provided for in the DOT regulations. ACC transports ORM-D shipments via ground only, we do not ship ORM-D by air.
Prohibited Items
ACC reserves the right to decline the shipment of certain items. Prohibited items for shipment with ACC include but are not limited to: Illegal goods or substances, cash or cash equivalents, coins, firearms or ammunition, jewelry, medical marijuana, precious metals, antiques or artwork, collectible stamps, animals alive or dead, toxic waste or fuel of any kind. ACC reserves the right, but is not required, to open and inspect any package at any time if we determine that such shipment would be likely to cause damage or delay to other shipments, equipment or personnel of the Company or if the transportation is prohibited by law. It is the responsibility of the shipper to ensure that a shipment tendered to ACC does not violate any federal, state, provincial, or local laws or regulations. No service shall be rendered by ACC in the transportation of any shipment that is prohibited by law.

Residential Delivery Service
Pick-ups and /or deliveries to residences in remote or less-accessible areas may be assessed an additional service fee. In addition, ACC’s shipping fees to residences only include one (1) delivery attempt.

Service Guarantee
All Counties Courier will, at its option, refund or cancel shipping charges in the event of a service failure. The following conditions apply:
- ACC must be notified in writing within 15 calendar days from due date of shipment. The customer
account number, tracking number and date of shipment are required in the notification. ACC reserves
the right to waive any claim received after 15 calendar days. - Shipping charges will be waived or cancelled only for those shipments delivered later than 15 minutes
after the guaranteed delivery time. (60 minutes for residences, government offices and retail stores). - ACC will not accept liability for failing to meet our delivery guarantee due to an incorrect address,
the unavailability of the consignee or refusal to accept the shipment. - Our guarantee does not apply to non-trackable mail, stamp packages, or to shipments delayed by
conditions beyond our control including, but not limited to, acts of God, air, land or sea transportation
delays, weather conditions, acts of public enemies or terrorists, war, strikes, civil commotion or acts
or omissions of public authorities including customs or health officials with actual or apparent authority. - In the event a shipment is not picked up by ACC and we are clearly at fault, we will pickup the shipment
on the following day at such a time that regular pick up service is available and deliver same-day, free
of charge to the billing party. - If a shipment is received by ACC that contains items needing temperature control (refrigeration), it is the
shipper’s responsibility to adequately package item to keep the required temperature for the duration of
the delivery time. ACC will not assume responsibility for perishable items.

Size & Weight Restrictions
ACC reserves the right to weigh all shipments and our policy is to round to the nearest pound. ACC utilizes industry standard practices with regard to special handling fees based on “Dimensional Weight” when a package it relatively light compared to its actual volume. All packages which due to length which special handling will also be subject to special handling fees. Packages weighing more than ACC’s published weight limitations will be subject to an additional charge of $.50 per pound for every pound over the limit. Undeliverable Packages & Second Attempt
ACC’s Next-Day service includes a second delivery attempt if the delivery location is closed on the first attempt. After the second delivery attempt, the package will be returned to the sender unless other arrangements are made. If a third attempt is requested, additional fees will apply.

Stamp Program & Shipping Label Policy
ACC-1 and ACC-2 program shipments with insufficient stamps will be assessed a service fee of $3.00 per package, plus $4.35 per stamp needed. Packages not properly labelled with an ACC barcode will be subject to a $5.00 service fee.
